1. Acceptance of Terms

By accessing and using the services provided by Foundation Billing and Medical Coding, LLC (“Foundation BMC,” “we,” “us,” or “our”), you (“student,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our services.

2. Educational Services

2.1 Program Description

Foundation BMC provides educational programs, courses, and training in medical billing and coding. Our services include:

  • Online and in-person instruction
  • Course materials and curriculum
  • Certification exam preparation
  • Career placement assistance
  • Student support services

2.2 Enrollment Requirements

To enroll in our programs, you must:

  • Be at least 18 years of age or have parental consent
  • Have a high school diploma or equivalent
  • Meet any specific program prerequisites
  • Complete all enrollment documentation accurately
  • Pay all required fees and tuition

3. Student Responsibilities

3.1 Academic Integrity

Students must:

  • Complete all coursework honestly and independently
  • Not engage in plagiarism, cheating, or academic dishonesty
  • Respect intellectual property rights
  • Maintain professional conduct in all interactions

3.2 Attendance and Participation

  • Students must meet minimum attendance requirements
  • Active participation in classes and assignments is expected
  • Failure to meet attendance requirements may result in dismissal

4. Payment Terms

4.1 Tuition and Fees

  • All tuition and fees must be paid according to the agreed payment schedule
  • Payment plans are available subject to approval
  • Additional fees may apply for materials, exams, or certifications

4.2 Refund Policy

  • Students may cancel within 3 business days for a full refund
  • After 3 business days but before class start: Maximum cancellation charge is $150 or 25% of contract price (whichever is less)
  • Refunds after course commencement are prorated based on percentage completed:
  • Within first 10% of program: 90% refund less cancellation charge
  • After 10% but within 25%: 75% refund less cancellation charge
  • After 25% but within 50%: 50% refund less cancellation charge
  • After 50% but within 75%: 25% refund less cancellation charge
  • After 75% of program: No refund
  • All refunds will be made within 30 days from the date of termination
  • Refund calculations based on last date of recorded attendance

5. Intellectual Property

5.1 Course Materials

  • All course materials remain the property of Foundation BMC
  • Students receive a limited license to use materials for educational purposes
  • Reproduction, distribution, or sale of materials is prohibited
  • Materials may not be shared with non-enrolled individuals

5.2 Student Work

  • Students retain ownership of their original work
  • Foundation BMC may use student work for educational purposes with permission
  • Submitted assignments may be checked for plagiarism

6. Privacy and Confidentiality

6.1 Student Information

  • We protect student educational records in accordance with FERPA and HIPAA
  • Personal information will not be disclosed without written consent
  • Student information will not be sold to other companies
  • Records maintained include: course/program name, class dates, attendance, final grades, and certificates of completion
  • Record requests may be refused for unpaid financial obligations or unresolved disciplinary actions

6.2 HIPAA Compliance

  • Students must maintain confidentiality of any patient information encountered
  • HIPAA training is required for all students
  • Violations of patient privacy may result in immediate dismissal

7. Technology Use

7.1 Online Learning Platform

  • Students are responsible for maintaining compatible technology
  • Internet access is required for online components
  • Technical support is available during business hours

7.2 Acceptable Use

  • Technology must be used for educational purposes only
  • Harassment, illegal activities, or inappropriate content is prohibited
  • Violations may result in loss of access and disciplinary action

8. Certification and Placement

8.1 Certification Exams

  • Foundation BMC prepares students for industry certification exams
  • Exam fees may be separate from tuition
  • Passing certification exams is not guaranteed
  • Additional exam attempts may require additional fees

8.2 Career Services

  • Career placement assistance is provided to graduates
  • Employment is not guaranteed
  • Students must actively participate in job search activities
  • Career services may be limited in duration

9. Code of Conduct

Students must:

  • Treat faculty, staff, and fellow students with respect
  • Maintain professional appearance and behavior
  • Follow all safety protocols and procedures
  • Report any concerns or violations promptly

10. Disciplinary Actions

10.1 Grounds for Discipline

Violations of these Terms may result in:

  • Warning
  • Probation
  • Suspension
  • Dismissal
  • Withholding of transcripts or certificates

10.2 Appeal Process

  • Students have the right to appeal disciplinary decisions
  • Appeals must be submitted in writing within specified timeframes
  • Appeal procedures are outlined in the Student Handbook

11. Limitation of Liability

11.1 Educational Outcomes

  • Foundation BMC does not guarantee specific educational outcomes
  • Success depends on individual student effort and ability
  • Career outcomes vary based on market conditions and individual qualifications

11.2 Damages

  • Our liability is limited to the amount of tuition paid
  • We are not liable for indirect, consequential, or incidental damages
  • This limitation applies to the fullest extent permitted by law

12. Dispute Resolution

12.1 Grievance Procedure

  • Students should first attempt to resolve issues directly with the person involved
  • If unresolved, contact the instructor to help mediate the issue
  • If still unresolved, submit a written grievance request for review by Foundation BMC administration
  • Foundation BMC will review the process and make final decisions
  • Students may file a complaint with the Division of Private Occupational Schools (DPOS) within two years of last attendance
  • Attempting to resolve issues with the school first is strongly encouraged

12.2 Arbitration

  • Disputes not resolved through internal processes shall be subject to binding arbitration
  • Arbitration will be conducted in accordance with applicable rules
  • Each party bears their own costs unless otherwise determined

13. General Provisions

13.1 Entire Agreement

These Terms constitute the entire agreement between you and Foundation BMC regarding the use of our services.

13.2 Modifications

  • We reserve the right to modify these Terms at any time
  • Students will be notified of material changes
  • Continued enrollment constitutes acceptance of modified Terms

13.3 Severability

If any provision of these Terms is found invalid, the remaining provisions shall continue in full force.

13.4 Governing Law

These Terms are governed by the laws of Colorado, without regard to conflict of law principles.
